The attention of the public, stakeholders in the healthcare sector, distributors, procurement agencies, development partners, exhibitors, and regulatory authorities is hereby drawn to a pending legal dispute before the Federal High Court involving Acouns Nigeria Limited and matters relating to the use of NAFDAC Registration Number 03-0622 in connection with the Determine HIV 1/2 Test Kit.

On 16 July 2024, the Federal High Court, Lagos Judicial Division, presided over by Hon. Justice K. O. Ogundare, granted an Interlocutory Injunction restraining the defendants, their agents, privies, nominees, representatives, or any person acting through them, from using NAFDAC Registration Number 03-0622 in respect of the Determine HIV 1/2 Test Kit for the purpose of importation into Nigeria, pending the hearing and determination of the substantive suit.

Acouns Nigeria Limited has become aware of circumstances giving rise to concerns that actions may be contemplated which could be inconsistent with the subsisting Order of Court.

Accordingly, members of the public, exhibitors, distributors, procurement institutions, development agencies, healthcare organizations, and all interested parties are hereby notified that Acouns Nigeria Limited has neither authorized nor consented to the use of its NAFDAC Registration Number 03-0622 for any purpose whatsoever, including but not limited to the exhibition, promotion, importation, distribution, marketing, commercialization, or other dealings relating to the Determine HIV 1/2 Test Kit while the matter remains before the Court.

Any action taken in contravention of the subsisting Order of Court may expose the responsible parties to legal consequences, including proceedings for contempt of court and such other remedies as may be available under applicable law.

Acouns Nigeria Limited remains committed to pursuing all lawful measures necessary to protect its rights and interests and to ensure compliance with the Orders of the Federal High Court.

This notice is issued without prejudice to the rights, claims, and remedies of Acouns Nigeria Limited in the pending proceedings.
