According to court filings reported this week, Swift’s attorneys called the lawsuit “absurd” and “meritless,” arguing that Flagg is trying to “prop up her brand” by associating herself with Swift’s massive popularity.
The dispute centers on Flagg’s 2015 trademark for Confessions of a Showgirl. She claims Swift’s album title is too similar and could confuse consumers. Flagg reportedly asked the court to stop Swift from selling merchandise connected to the album while the case moves forward.
Swift’s lawyers argued that the two brands operate on completely different scales — comparing Swift’s stadium tours and global fanbase with Flagg’s smaller cabaret performances. They also accused Flagg of using hashtags linked to Swift and her fans to boost visibility after the album announcement.
Flagg’s legal team, however, says the case is about protecting a trademark she has used for years. Reports also note that the U.S. Patent and Trademark Office previously raised concerns about similarity between the two names when Swift attempted to trademark her album title.
The case is expected to continue in federal court later this month.
